This Privacy Policy explains how Kater collects, uses, shares, and protects your personal data when you use the Kater platform. It should be read together with our Platform Terms.

We handle personal data in line with Ghana's Data Protection Act, 2012 (Act 843).

1. Who we are

The platform is operated by KOOK Technologies Limited, a company registered in Ghana with registered office at D67 Tse Addo High Street, Accra ("Kater", "we", "us", "our"). For the purposes of Act 843, Kater is the data controller for the personal data described in this Policy, except where stated otherwise in section 8 (Portals).

2. Who this Policy covers

This Policy applies to Users of the platform, including:

  • people who order Meals through a Kater Hub; and

  • people who use the platform through their employer's Portals.

If you use the platform through your employer's Portal, your employer also handles your data and will have its own privacy notice. Section 7 explains how responsibility is split.

3. The personal data we collect

Data you give us:

  • account details such as your name, email address, phone number, and password;

  • your workplace or building, and your delivery location (for example, floor or desk);

  • your Orders and any notes you add to them;

  • messages you send us, for example when you make a complaint.

Data about your payments:

  • your payments are processed by a third-party payment provider. We receive confirmation of payment and limited transaction details. We do not collect or store your full card number. For more details on the privacy policy of the third-party payment provider we use, read here.

Data we collect automatically when you use the platform:

  • device and app information, log data, and general usage information;

  • cookies and similar technologies (see section 9).

Data we receive from others:

  • from your employer, where you use Portals, such as your eligibility to use the service and your work contact details;

  • from our payment provider, as described above.

Health-related dietary information. If you enter allergy or other health-related dietary information (for example in an Order note), we treat it as sensitive personal data. We use it only to pass to the Vendor so they can prepare your Order, and we rely on your explicit consent to do so. You do not have to provide it, and if you have allergies we also encourage you to confirm directly with the Vendor.

4. Why we use your data, and our lawful basis

Under Act 843, we may process your personal data where it is necessary to provide the service you have asked for, to meet a legal obligation, to protect your or our legitimate interests, or where you have given consent. We use your data to:

  • create and manage your account, and let you use the platform;

  • receive, confirm, and fulfil your Orders (necessary to perform your Order);

  • take payment and issue receipts (necessary to perform your Order);

  • share your Order with the relevant Vendor so it can be prepared and delivered (see section 5);

  • respond to your questions and complaints;

  • keep the platform secure and prevent fraud or misuse (our legitimate interest);

  • improve and develop the platform (our legitimate interest); and

  • meet our legal, tax, and regulatory obligations.

We send you service messages about your Orders as part of providing the service. We only send you marketing messages where you have consented, and you can withdraw that consent at any time.

5. Who we share your data with

Vendors. When you place an Order, we share the details the Vendor needs to prepare and deliver it, including your name, your Order, your contact details, and your delivery location. The Vendor uses this data to fulfil your Order and is responsible for its own handling of it.

Our payment provider, to process your payment.

Your employer, where you use Portals, we may share your use of the service and Order information with your employer, as set out in section 8.

Service providers who help us run the platform, such as hosting, analytics, and communications providers, acting on our instructions.

Authorities or third parties where we are required to by law, or to establish, exercise, or defend legal claims.

We do not sell your personal data.

6. How long we keep your data

We keep your personal data for as long as your account is active and you use the platform. After that, we keep it only as long as we need to, including to:

  • handle any complaints or disputes;

  • keep Order and payment records for the period required by Ghanaian tax and accounting law and

  • meet other legal obligations.

When we no longer need your data, we delete it or make it anonymous.

7. Portals (data handled with your employer)

Where you use the platform through your employer's Portals, your employer decides some of the ways your data is used, for example which vendors are available and how the program is run. For those uses, your employer is a data controller and Kater acts on your employer's instructions. Your employer's own privacy notice applies to those uses, alongside this Policy.

For everything else described in this Policy, Kater remains the controller.

8. Cookies

We use cookies and similar technologies to make the platform work, to keep you signed in, to remember your preferences, and to understand how the platform is used. You can control cookies through your browser or device settings, though some features may not work properly without them.

9. Your rights

Under Act 843, you have the right to:

  • be told what personal data we hold about you and how we use it;

  • access your personal data;

  • ask us to correct data that is inaccurate or incomplete;

  • object to or ask us to stop certain processing, including for direct marketing;

  • withdraw your consent where we rely on it; and

  • complain to the Data Protection Commission if you believe we have not handled your data properly.

10. How we protect your data

We take reasonable technical and organisational measures to protect your personal data against loss, misuse, and unauthorised access. No system is completely secure, but we work to keep your data safe and to deal quickly with any issue that arises. If a data breach occurs that we are required to report, we will notify the Data Protection Commission and, where required, affected Users.

11. Children

The platform is intended for adults using it in a workplace setting and is not directed at children. We do not knowingly collect personal data from anyone under 18.

12. Changes to this Policy

We may update this Policy from time to time. We will post the updated version on the platform and, where the change is significant, take reasonable steps to let you know. If you continue to use the platform after an update takes effect, you accept the updated Terms.
